Super Bowl advertisers seek buzz on social media (Reuters)

NEW YORK (Reuters) ? In the age of Twitter and Facebook, many Super Bowl viewers will use the commercial breaks to go online and see what people are saying about the game. This year, advertisers want them to tweet about their favorite commercials as well.

Having spent record-breaking sums to secure the most valuable television slots in advertising, global brands from Coca-Cola to Volkwagen are looking to leverage social media to extend the buzz and reach of their ads.

According to executives from Comcast Corp's NBC television network, which will broadcast the February 5 football game, a 30-second commercial slot cost $3.5 million on average this year, up from $3 million for last year's Super Bowl, which was on News Corp's Fox station.

"The social media conversation has put more value on a Super Bowl ad, fans will discuss your ads on Twitter and Facebook and then go to YouTube to watch it on demand over and over again," said Brad Adgate, senior vice president of research at Horizon Media.

This year's Super Bowl will take place in Indianapolis, with the New York Giants and New England Patriots battling it out for the National Football League Championship. An expected 100 million people will watch the game, which is among a dwindling number of TV programs that still draw big live audiences.

NFL games are so valuable to advertisers that the league recently secured hefty pay increases that will bring in about $6 billion a year from Walt Disney Co's ESPN, broadcast networks and satellite TV provider DirecTV for rights to air games and sell the advertising time.

The average price of Super Bowl ads have risen more than 50 percent in the last 10 years, defying economic downturns and secular industry issues. NBC sold out all 70 spots around this year's game shortly after Thanksgiving weekend in November and reached a new high with one slot selling for around $4 million.

The game, including lower priced halftime slots, could easily generate over a quarter of a billion dollars in ad sales.

"The overall demand for Super Bowl spots is very high this year," said Tim Calkins, marketing professor at Northwestern University's Kellogg School of Management. "Prices are high. Demand is high. I think that's a very positive sign for the economy."

Consumer research forecasts that 60 percent of fans watching the Super Bowl will also be tied into a second screen such as a smartphone or tablet.

COKE Vs PEPSI ON SOCIAL MEDIA

Anheuser-Busch, which typically buys exclusivity as the only beer advertiser during recent Super Bowls, is again the biggest spender, according to industry sources.

Not unlike past Super Bowls, Coca Cola Co and PepsiCo Inc will face-off for soda supremacy. Both beverage makers have come up with campaigns that attempt to leverage social media after their commercials air.

Coca-Cola's TV commercials, which will air during the first-and second-quarter breaks, will center around its computer-generated Arctic polar bears watching the game. The bears will then be brought to life on Twitter, Facebook and on a dedicated Website doing such things as responding to fans and commenting on the game. They will even have their own Twitter hashtag --#GameDayPolarBears -- for fans to follow.

"We wanted to interact with consumers in the most simple and organic way so they would have nothing to do other than what they usually do," said Pio Schunker, Coca Cola senior vice president of integrated marketing platforms.

Fans who catch Pepsi's commercial with "X Factor USA" winner Melanie Amaro performing the Otis Redding song "Respect" will be able to download a free video of the performance by using the Shazam app on their phones to capture audio from the commercial.

There are also partnerships with online radio service Pandora Media Inc and social TV specialist GetGlue centered around the game and other free content.

"Our philosophy now is nothing happens in isolation," said Shiv Singh, global head of digital for Pepsico Beverages. "Social TV is a massive phenomenon and a critical element of our Super Bowl campaigns."

AUTOS SPEND BIG AGAIN

The biggest spender by category is the autos industry, which made a big comeback last year and was noted for one of the most memorable spots -- Volkswagen AG's ad with a young child dressed in a Darth Vader outfit believing he can control the Passat car's lights.

This year, Volkswagen's Audi is hoping to win more creative kudos with a spot that taps into the "Twilight" teen vampire pop culture phenomenon. The 60-second spot, which will air during the first break in the game, will highlight the new 2013 Audi S7 and its LED headlight technology, which has unfortunate consequences for a party of young vampires.

Audi hopes to continue the conversation about the ad via the Twitter hashtag #SoLongVampires.

NBC executives say the auto makers are leading a trend toward long-form campaigns of 60 seconds or more, allowing high-end creative concepts to be fleshed out in the commercial's narrative rather than just going for a quick gag and punchline.

Chrysler Group LLC, Toyota Motor Co, Honda Motor Co Ltd, Hyundai Motor Co, and other automakers will also be advertising during the game.

General Motors Co's mainstream Chevy brand will run seven TV commercials before, during and after the game, for instance. It will also center its overall campaign heavily around Web-based partnerships with NBC, Twitter and Facebook.

SOCIAL MEDIA HELPS SELL

With the conventional wisdom being that consumers are more likely to make a purchase if recommended by a friend or family member, chief marketing officers are keen to insert themselves in a Facebook or Twitter conversation about the products and services they sell.

Bluefin Labs, a start-up company that aggregates and analyzes TV viewer data and comments on Twitter and Facebook, has been hired by several advertising agencies with Super Bowl campaigns to help understand how football fans react to the commercials during the game.

"Advertisers don't think about the TV campaign alone anymore but as a way to reach eyeballs and then stimulate conversations about their brands," said Bluefin executive Tom Thai.

While advertisers are eager to experiment with social media during a big-ticket event like the Super Bowl, there are still questions on how they measure its impact with a consistent, industry-accepted method, said Alex Iskold, founder of GetGlue, which lets TV fans share their viewing experiences by 'checking-in' in exchange for online rewards.

"Social TV engagement hasn't been fully priced yet," Iskold said. "We are collectively working to figure out the value to the advertisers. "It took years for the traditional display ad model to solidify; I don't think it will take us that long to price social TV."

NASA study solves case of Earth's 'missing energy'

ScienceDaily (Jan. 27, 2012) ? Two years ago, scientists at the National Center for Atmospheric Research in Boulder, Colo., released a study claiming that inconsistencies between satellite observations of Earth's heat and measurements of ocean heating amounted to evidence of "missing energy" in the planet's system.

Where was it going? Or, they wondered, was something wrong with the way researchers tracked energy as it was absorbed from the sun and emitted back into space?

An international team of atmospheric scientists and oceanographers, led by Norman Loeb of NASA's Langley Research Center in Hampton, Va., and including Graeme Stephens of NASA's Jet Propulsion Laboratory in Pasadena, Calif., set out to investigate the mystery.

They used 10 years of data -- spanning 2001 to 2010 -- from NASA Langley's orbiting Clouds and the Earth's Radiant Energy System Experiment (CERES) instruments to measure changes in the net radiation balance at the top of Earth's atmosphere. The CERES data were then combined with estimates of the heat content of Earth's ocean from three independent ocean-sensor sources.

Their analysis, summarized in a NASA-led study published Jan. 22 in the journal Nature Geosciences, found that the satellite and ocean measurements are, in fact, in broad agreement once observational uncertainties are factored in.

"One of the things we wanted to do was a more rigorous analysis of the uncertainties," Loeb said. "When we did that, we found the conclusion of missing energy in the system isn't really supported by the data."

"Our data show that Earth has been accumulating heat in the ocean at a rate of half a watt per square meter (10.8 square feet), with no sign of a decline," Loeb said. "This extra energy will eventually find its way back into the atmosphere and increase temperatures on Earth."

Scientists generally agree that 90 percent of the excess heat associated with increases in greenhouse gas concentrations gets stored in Earth's ocean. If released back into the atmosphere, a half-watt per square meter accumulation of heat could increase global temperatures by 0.3 or more degrees centigrade (0.54 degree Fahrenheit).

Loeb said the findings demonstrate the importance of using multiple measuring systems over time, and illustrate the need for continuous improvement in the way Earth's energy flows are measured.

The science team at the National Center for Atmospheric Research measured inconsistencies from 2004 and 2009 between satellite observations of Earth's heat balance and measurements of the rate of upper ocean heating from temperatures in the upper 700 meters (2,300 feet) of the ocean. They said the inconsistencies were evidence of "missing energy."

Other authors of the paper are from the University of Hawaii, the Pacific Marine Environmental Laboratory in Seattle, the University of Reading United Kingdom and the University of Miami.

Taxpayers still owed $132.9B from bailout: report

(AP) ? A government watchdog says U.S. taxpayers are still owed $132.9 billion that companies haven't repaid from the financial bailout, and some of that will never be recovered.

The bailout launched at the height of the financial crisis in September 2008 will continue to exist for years, says a report issued Thursday by Christy Romero, the acting special inspector general for the $700 billion bailout. Some bailout programs, such as the effort to help homeowners avoid foreclosure by reducing mortgage payments, will last as late as 2017, costing the government an additional $51 billion or so.

The gyrating stock market has slowed the Treasury Department's efforts to sell off its stakes in 458 bailed-out companies, the report says. They include insurer American International Group Inc., General Motors Co. and Ally Financial Inc.

If Treasury plans to sell its stock in the three companies at or above the price where taxpayers would break even on their investment ? $28.73 a share for AIG, $53.98 for GM ? it may take a long time for the market to rebound to that level, the report says. AIG's shares closed Wednesday at $25.31, while GM ended at $24.92. Ally isn't publicly traded.

It will also be challenging for the government to get out of the 458 companies as the market remains volatile and banks struggle keep afloat in the tough economy, it says.

Congress authorized $700 billion for the bailout of financial companies and automakers, and $413.4 billion was paid out. So far the government has recovered about $318 billion. The bailout is called the Troubled Asset Relief Program, or TARP.

"TARP is not over," Romero said in a statement. She said her office will maintain its commitment to protect taxpayers for the duration of the program.

Treasury spokesman Matt Anderson said the department "has made substantial progress winding down TARP and has already recovered more than 77 percent of the funds disbursed for the program, through repayments and other income."

"We'll continue to balance the important goals of exiting our investments as soon as practicable and maximizing value for taxpayers," Anderson said.

The government has unwound its investments in four of the companies that received the most aid: Bank of America Corp., Citigroup Inc., Chrysler Group LLC and Chrysler Financial, the automaker's old lending arm.

On Wednesday, Treasury announced that it had sold the final batch of securities under its $368 million Small Business Administration loan program under TARP.

In Romero's quarterly report to Congress, she said her office has uncovered and prevented fraud related to TARP. Investigations by her office have resulted in criminal charges against 10 people and three convictions, the report notes.

(AP) ? An American aid worker rescued by Navy SEALs in Somalia was a student leader at her Christian grade school, attended a religious college in suburban Philadelphia and "fell in love with Africa" while doing student teaching in Nairobi.

The Rev. Don Meyer, president of Valley Forge Christian College, said everyone at the small school in suburban Philadelphia is thankful their prayers have been answered with word that 2007 graduate Jessica Buchanan, 32, was rescued along with Poul Hagen Thisted, a 60-year-old Dane. The two were working with a demining unit when gunmen kidnapped them in October.

"Ever since Jessica was captured, we all as a community have been praying for her safety and for her safe release," Meyer said in a telephone interview. "The priority is just how grateful we are that she is safe."

The SEALs parachuted down in the early morning darkness Wednesday, killing nine kidnappers and freeing Buchanan and Hagen.

President Barack Obama ordered the rescue after intelligence indicated Buchanan's health was failing, according to a senior administration official who was not authorized to speak publicly. A Danish Refugee Council official said Buchanan was "not that ill" but needed medicine.

The family reported that her health is good, Meyer said. Relatives did not immediately comment.

The family had asked people at the school to keep quiet about the case while authorities tried to negotiate Buchanan's release, Meyer said. Now, he said, the school wants to offer its "deep gratitude" to the people who worked to free her.

Buchanan was an elementary education major at Valley Forge Christian, which has about 1,100 students, and had done a student teaching stint at Rosslyn Academy in Nairobi as part of her course work, Meyer said.

"She fell in love with Africa," he said. "She could hardly talk about Africa without tears in her eyes."

Minutes after giving his State of the Union address to Congress, Obama was on the phone with Buchanan's father to tell him his daughter was safe.

"Her life story is a model of what we prepare our students to do," Meyer said. "Now, the priority, though, is that she be joined with her family. ... It's thrilling beyond words."

Before Buchanan's family moved from Ohio years ago, she attended the now-closed Ridgeville Christian School, a preschool-through-12th-grade campus in Springboro, north of Cincinnati.

There, she was a student leader very involved in activities and sports, including basketball and volleyball, said retired high school science teacher Roy Merrill.

"She was an outstanding student," Merrill said. "She had a lot of drive to get things done."

Elementary school teacher Carol Richards said Buchanan and her family were "very Christian people."

"We are so excited," she said of the rescue. "Many prayers have been answered."

Vaccination program credited in fight against whooping cough

Facing an epidemic of whooping cough that led to the deaths of 10 infants in 2010, California public health officials launched a massive vaccination effort and public awareness campaign about the disease.

And on Tuesday, they announced the payoff: no deaths in 2011, a first in two decades. The number of whooping cough, or pertussis, cases also plummeted from about 9,154 in 2010 to 2,795 in 2011, according to the California Department of Public Health.

In Los Angeles County, the number of cases dropped from 1,395 in 2010 to 520 in 2011. Four of the deaths in the state occurred locally.

"Controlling an outbreak is huge," said Dr. Gil Chavez, deputy director of infectious diseases for the state. "It really happens in a partnership."

The state worked closely with doctors, hospitals, schools and clinics to get more people vaccinated and to get pertussis identified and treated earlier, Chavez said.

Pertussis is a bacterial disease that infects the respiratory system. Children and adults may have severe coughing with a whooping sound at the end of a spasm. Infants may have a runny nose and a cough without the whoop sound.

Chavez said that the deaths can also be prevented if cases are identified and treated quickly, usually with antibiotics."To have gone through a year like 2011 with 3,000 cases and having no fatalities is pretty remarkable," he said.

Infants are the most vulnerable because they are not fully vaccinated until they are 6 months old. As a result, public health officials urged pediatricians to watch out for the disease and to get babies treated immediately after a diagnosis to improve their chances of survival.

"That is probably the most important thing," said Dr. James Cherry, a pediatrics professor at UCLA and an expert in pertussis. "If you get babies in hospitals, in ICUs, they are more likely to survive."

Babies often get pertussis from parents and others who have been misdiagnosed as having asthma or bronchitis, Cherry said. So in their vaccination efforts, state and local health departments focused on vaccinating people who were around infants, including pregnant and postpartum mothers, grandparents and older siblings.

The state also passed a law in 2010 requiring the immunization of students entering grades 7 to 12. Most children are vaccinated for pertussis, but it wanes after about five years. The vaccine is included in the DTaP inoculation, which also protects against tetanus and diphtheria.

"I don't think there was a lot of awareness of the transmission of this from older siblings," said Dr. Jonathan Fielding, Los Angeles County's director of public health.

Fielding said health officials throughout California need to continue being vigilant so the numbers don't increase again. "We have to make sure we don't let our guard down," he said.

Your cellphone can now sing like Obama

During a?campaign stop at the Apollo Theater in New York City last week,?President Obama surprised the audience by singing the opening lines of "Let's Stay Together,"?the classic tune by Rev. Al Green ??who was on site that evening. Now you can download Obama's rendition of the song as a ringtone for your cellphone.

Yes, you can now really hear the President sing "I'm so in love with you" every time your phone rings. All you have to do is head to the official Obama website and you'll find links to download the brief sound clip.

The ringtone appears to be a recording of Obama's Apollo performance ? audio of the audience cheering unfortunately distracts from the actual singing.

But?perhaps there's hope that someone will convince the President to record a new tune for those who want more. (And?based on a poll by TODAY.com, there are quite a few of those folks out there.)

After all, while Obama must've discussed his singing talents with members of his staff ? he points out that "they" didn't think he'd perform?? on the evening of his performance, many seemed unaware of just how gifted the President is.

Even White House communications director Dan Pfeiffer remarked that he didn't know that Obama could sing until the evening at the Apollo Theater,?says Reuters.

But now that the cat's out of the bag, someone's bound to use it as part of a campaign strategy.

President Barack Obama's spontaneous singing is now a downloadable ringtone. NBC's Savannah Guthrie reports.

RIM stock falls eight percent following CEO transition

We rarely meddle with stock news around these parts, but this was a pretty significant piece of meat to chew on. After Research in Motion introduced Thorsten Heins as the new CEO last night and again in a conference call this morning, the company's stock price tumbled a whopping 8.47 percent. When it comes to what kind of difference the transition will make for the struggling company, we haven't had a high amount of confidence; while we hope for the best and want to see RIM turn things around, the falling stock appears to indicate that we're not alone in expressing concerns about this morning's events. Here's some food for thought: when rumors that Samsung was interested in purchasing RIM flooded the internet, the latter company's stocks spiked by nearly ten percent.

Nationals' Morse agrees to multiyear deal (Reuters)

(Reuters) ? The Washington Nationals have signed outfielder/infielder Mike Morse to a multiyear contract extension, thus avoiding salary arbitration, the Major League Baseball (MLB) said on Friday.

Contract terms were not announced, but Washington media reported the deal was for two years for Morse, who had been asking for $5 million.

Morse, 29, led the Nationals in batting (.303 average), home runs (31) and runs batted in (95) last season.

Just how much do you trust your spouse or partner? Enough to share passwords? For some, passwords are the final frontier of privacy not only in financial matters, but in social media and email correspondence. But for others, there are no secrets when you're in a relationship?? even risking the potential payback should a break-up sever the happy union.

The New York Times tells us about an "intimate custom" writer Matt Ritchel says is happening between teens in love: "sharing their passwords to email,?Facebook?and other accounts." The desire to be one even extends, the article claims, to couples creating identical passwords and letting each other read private emails and texts.?

For some, it takes a court order to share so much.

But for others, it's imperative to know each other's passwords as part of an open, healthy and fully functioning relationship. Sometimes this comes after a loss of trust, as when one partner has cheated on the other. On the Surviving Infidelity website, where more than 34,000 members have exchanged stories of betrayal and support one another in the forums, there is a saying that becomes a mantra for many of them: "Those who have nothing to hide, hide nothing." To that end, nothing is private anymore in order to facilitate healing for the offended party.?

In this philosophy, those who have been unfaithful should share (or make open and available) not only passwords to their email accounts and Facebook, but also the contents of their text messages, phone logs, work and travel itineraries "without qualms."

Many in those forums mention how finding secret Facebook and email correspondences led to the big reveal of infidelity in their marriages and relationships, and we've seen surveys that attribute at least some fault in Facebook, though an informal poll we took at the end of year showed that nearly half of the 876 votes attributed the demise of their marriages with other factors. But 34 percent did blame Facebook.

Some of the teens in the New York Times article who opened themselves up were dealt a nasty lesson in human nature when their not-so-better halves decided to use the passwords in retaliation for perceived wrongs. The Times listed some examples:

The stories of fallout include a spurned boyfriend in junior high who tries to humiliate his ex-girlfriend by spreading her e-mail secrets; tensions between significant others over scouring each other?s private messages for clues of disloyalty or infidelity; or grabbing a cellphone from a former best friend, unlocking it with a password and sending threatening texts to someone else.

Mailing it in: In South Carolina, a trip to the post box says everything about the GOP campaign (The Ticket)

ELGIN, S.C.--It can take my mail-lady more than the average 10 seconds to fill my box these days. Earlier this week, she even had to roll back, because she thought she might have missed something. I was able to walk out to greet her before she got through cramming everything in.

"Make sure all my campaign stuff is there," I said.

"Oh absolutely," she said. "We have to suffer to put it in, and you have to suffer to take it out."

That day's mess of campaign pottage brought the usual: two flyers from Mitt Romney, one from Ron Paul and, bless his heart, a flyer from Rick Perry--who had already dropped out of the race and endorsed Newt Gingrich.

His flyer had a different message. It urged me not to waste my vote on Newt Gingrich, or Rick Santorum.

After resigning from Congress, the flyer said, Gingrich made $1.6 million from Freddie Mac, a lending institution that "helped create the housing crisis." Gingrich advised both lenders, "in his capacity as a 'historian,'" the flyer added. "But Americans have had enough history with insiders who use their previous service to make a quick buck."

Also, Santorum "sold out his conservative principles" when he backed Sen. Arlen Specter, who turned Democrat and helped pass Obamacare.

It was, obviously, too little and way too late, but the bad timing of this missive offers some insight into just how nervous campaigns become in the final clinch.

Looking at that sad little flyer from Perry, I could sense the sheer sweaty anxiety as his campaign finally crumbled. Surely a flurry of phone calls went back and forth: Have you sent out that Perry flyer? No? Well hold off, let me call headquarters ... Yes, they're saying don't send it ?no, they're saying do send it, yes, go, get to the P.O. by five ? Hi, me again, you didn't already send it, did you? You did? Damn?

If you let your campaign mail pile up for a week instead of throwing it away, and stop clicking the channel when attack ads come on--both of which I did for the sole purpose of writing this article--the daily barrage serves as a barometer of who's leading, who is closing in, who has the most cash, and who is desperate.

The flyer was the first piece of mail I'd seen from Perry in weeks. Newt Gingrich, who at this writing is either threatening Romney's lead or has overtaken it, hasn't been much of a mail guy either: two flyers, both hitting Romney, one for his "Pro-Abortion Record" and one for his deficit-reduction plan. Not only that, Romney is the "second most dangerous man in America."

Yes, it's that time in the campaign. If you have red meat, please throw it to the crowd.

I haven't received squat from Santorum (but you can't miss him on TV, either boosting himself in his own ads or being attacked in someone else's). The only real players in the mailbox battle, so far as I can tell, are Mitt Romney and Ron Paul?the leading candidate and the man in third.

The Romney flyers are confident. They are the work of someone shoring up his base. Although the former Massachusetts governor is trying to remind everyone that he is not a so-called "Washington insider," he is also letting people know that he has the approval of the establishment. He has the endorsement of South Carolina's governor, Nikki Haley, and he kinda sorta has the blessing of Jim DeMint, South Carolina's U.S. senator from the tea party. (Actually, DeMint hasn't endorsed anyone, but he did say something Romneyish in 2007, and again in 2012. Both quotes are on one of the flyers.)

Romney's attack mail focuses squarely on Gingrich and Santorum, easily and effectively using images to make his case: Newt's scowling, porcine head versus? Romney's tall, Lincolnesque bearing; ?Santorum biting his lip in frustration versus smiling, confident Romney, backed by an American flag and an applauding Nikki Haley.

Romney doesn't, so far as I can tell, even acknowledge Ron Paul, although Paul obviously can't afford not to notice Romney. The other day I got a letter from Paul: "Do you believe Palmetto State workers should be forced to pay a union boss just to have a job and feed their families?"

Although Paul lets his libertarian freak flag fly during debates, on the home front he knows that you can't really win my state without appealing to the hard right: against unions, against abortion, against Obamacare. A few days ago, he sent a long letter detailing his anti-abortion stance. Just after that, he sent a DVD.? He says everything pro-lifing, climate change-denying, immigrant-loathing voters want to hear: Romney "said abortion should be legal"; Gingrich "wants to give illegal aliens citizenship"; Perry "endorsed environmental fraud Al Gore for President." He's a 76-year- old man with a one-time title shot, and it shows.

By its nature, the TV campaign is louder and more relentless, as every commercial break on the Today show and the local evening news is filled with voices cancelling each other out, as each candidate proclaims he's the only one who can beat Obama.

Ron Paul goes after Gingrich and Santorum as "serial hypocrites" who "can't be trusted." Gingrich likewise attacks Romney as a pro-abortion governor who "can't be trusted." Romney's Restore America's Future Super PAC, in an ad of perhaps questionable effectiveness, hits Gingrich because he keeps on admitting to making mistakes-- a bad thing, apparently. More to the point, Paul outlines Gingrich's contradictions, using clips of Rush Limbaugh, Megyn Kelly and Ed Schultz, while a creepy Phillip Glass-like score plays ominously in the background.

"This is the cauldron," Henry McMaster, the state attorney general, told me last week at the University of South Carolina's Moore School of Business, where his candidate Jon Huntsman was fielding questions. "We're out of the frying-pan and into the fire, because South Carolina, historically, beginning in 1980, is the one who picked the president."

Last weekend, his man had picked up the endorsement of The State newspaper. He dropped out mere hours later.

That's how fast it goes in this ongoing battle for the vote of Current Resident, set to conclude today. The mail lady and I are looking forward to it.

SF sheriff pleads not guilty to domestic violence (AP)

SAN FRANCISCO ? San Francisco's new sheriff has pleaded not guilty to domestic violence and other charges stemming from allegations that he mistreated his wife in front of their toddler son and told her not to tell anybody about it.

Sheriff Ross Mirkarimi's (meer-kah-REEM'-ee) lawyer, Robert Waggener, entered the not guilty pleas at Mirkarimi's arraignment Thursday in San Francisco Superior Court.

Besides the domestic violence charge, prosecutors have also charged the 50-year-old sheriff with child endangerment and dissuading a witness. The three misdemeanor charges come after a New Year's Eve incident with his wife, Eliana Lopez, at their home.

Mirkarimi is free on $35,000 bail. He says he has no intention of stepping down as sheriff.

San Francisco's new sheriff will appear in court Thursday to answer allegations he mistreated his wife in front of their toddler son and told her not to tell anybody about it.

Sheriff Ross Mirkarimi is expected to plead not guilty at his arraignment in San Francisco Superior Court, his lawyer, Robert Waggener, said Wednesday.

The hearing comes nearly one week after prosecutors charged Mirkarimi, 50, with domestic violence battery, child endangerment and dissuading a witness, all misdemeanors, in connection with a volatile New Year's Eve incident with his wife, Eliana Lopez, at their home.

"This isn't a physically abusive relationship. It was an argument," Waggener said. "I think there's a fair chance that we're going to ask for a speedy trial within 45 days."

Waggener also said the lawyer for Mirkarimi's wife may ask the judge to lift a protective order barring him from having contact with his family. Lopez's attorney, Cheryl Wallace, did not return calls seeking comment.

According to an arrest warrant affidavit released Tuesday, Mirkarimi is alleged to have mistreated his wife on two separate occasions last year and to have told her he was a "very powerful" man who could take away their son.

Lopez appeared on a Jan. 1 videotape candidly discussing the Dec. 31 confrontation and another incident earlier last year, according to the affidavit.

The footage was shot by a neighbor, Ivory Madison, whose call to police prompted an investigation. Lopez is crying and visibly upset about the couple's run-in the day before, the affidavit said, and she points to a bruise on her right bicep where she said Mirkarimi grabbed her.

"This happened yesterday," Lopez tells the camera. "Two times in 2011, and this is the second time this is happening."

Madison eventually told police investigators what Lopez had relayed to her but would not surrender the videotape. Police obtained it and other evidence through a search warrant.

Investigators from the district attorney's office later found another neighbor who gave an account similar to Madison's and said Lopez described Mirkarimi as "going ballistic." The neighbor also said the couple's son told his mother, "Daddy made boo-boo on Mommy's arm."

Lopez, a former Venezuelan telenovela star, married Mirkarimi after having their first child in 2009. On Wednesday, Lopez told a Venezuelan radio station that Mirkarimi did not abuse her and he is a victim of "very dirty politics."

Meanwhile, several domestic violence groups have called for Mirkarimi to either step aside temporarily until the case is closed or resign.

Mirkarimi, who was sworn in as sheriff nearly two weeks ago after serving two terms as a San Francisco supervisor, said he has no intention of leaving his new post.

RIM shares jump on report of sale efforts (Reuters)

(Reuters) ? Shares of Research In Motion jumped more than 10 percent on Tuesday after a tech blog said the BlackBerry maker was actively seeking to sell itself to South Korean smartphone rival Samsung Electronics.

The Boy Genius Report website cited an unidentified source saying that RIM co-Chief Executive Jim Balsillie was meeting with companies interested in either licensing its software or buying a part or all of RIM, with Samsung leading the pack.

Jefferies analyst Peter Misek later said the report of the Samsung talks was likely true but that licensing deals for RIM's upcoming phone software was a more likely scenario and would in turn lead to a major restructuring.

A Samsung spokesman and a RIM spokeswoman both declined to comment.

RIM has been the target of a steady stream of takeover speculation in recent months as its market valuation has crawled along at multi-year lows. Product delays and profit warnings have eroded confidence in RIM and its management.

Samsung, which has emerged as the No. 1 smartphone manufacturer on the back of booming demand for its Android-based models, said on Tuesday it plans to merge its own "bada" operating system with an open-source platform supported by chipmaker Intel.

Android, the world's most popular smartphone operating system, is owned by Google and used by a slew of handset manufacturers, including Motorola Mobility and HTC, as well as Samsung.

Jefferies' Misek said Samsung and HTC might both be interested in paying RIM $10 per device to use its fresh operating system. That would give them access to the 75 million-plus BlackBerry users and limit their dependence on Android.

He said RIM could announce a deal within three months and the appointment of a new chairperson could speed up the process.

Balsillie and fellow chief executive Mike Lazaridis also share a role as chairman of the board, but a committee made up of the rest of RIM's board is due to report on possible changes to the unusual structure by the end of January after pressure from investors.

RIM's stock has jumped more than 6 percent four times since December 21, when Reuters reported that Amazon.com and other possible buyers had considered a bid. It is still down almost 75 percent from a year ago.

RIM's Nasdaq-listed shares were up 10.3 percent at $17.83 by early Tuesday afternoon, while the Toronto-listed stock rose 7.6 percent to C$18.15, adding to its gains on Monday when U.S. markets were closed.

7 charged in $62 million Dell insider-trading case (Reuters)

NEW YORK (Reuters) ? Seven people were charged with a scheme to reap nearly $62 million in illegal profits on trades on Dell Inc shares, the latest salvo in a sweeping probe of suspicious trading at hedge funds.

The FBI in New York arrested four people on Wednesday and authorities announced previously secret charges against three others, making this case one the largest in the office's long -running probe of insider trading.

Dubbed the "Perfect Hedge," the probe has examined suspected sharing of confidential business information with hedge fund managers and analysts. Galleon Group hedge fund tycoon Raj Rajaratnam was arrested as part of the investigation and is now serving an 11-year prison term.

The defendants arrested on Wednesday include Anthony Chiasson, who co-founded the Level Global Investors hedge fund. He turned himself in to the FBI in New York, an agency spokesman said.

Todd Newman, who headed technology trading for hedge fund Diamondback Capital Management from Boston, was also arrested, the spokesman said.

Chiasson and Newman are accused of illegally trading ahead of computer maker Dell Inc 's 2008 first- and second- quarter earnings announcements, netting them $57 million and $3.8 million respectively in profits. Another defendant, Jon Horvath, is accused of making a $1 million, illegal Dell trade. The earnings information was provided by an unnamed source at Dell and relayed to the defendants, court documents said.

A Dell representative could not immediately be reached for a c comment. Lawyers for the trading defendants could not immediately be reached for a comment.

Newman had been placed on leave of absence from Diamondback in 2010 and subsequently was let go by that firm. Reuters in November reported the government's interest in Newman.

Chiasson, Newman, Horvath and one other were charged in U.S. District Court in Manhattan with one count each of conspiracy to commit securities fraud and securities fraud, according to court document.

Horvath, who was also arrested on Wednesday, is currently employed at Sigma Capital management, a unit of Steven A. Cohen's $14 billion hedge fund SAC Capital, said a person familiar with the case who is not authorized to speak publicly.

A spokesman for SAC Capital could not immediately be reached for comment.

A fourth person was arrested in Los Angeles earlier on Wednesday, the FBI spokesman said.

Charges also were made public against three other people who previously have pleaded guilty and are cooperating with the government, court documents showed.

The three are: Sandeep Goyal, a former Dell employee; Spyridon Adondakis, a former junior analyst at Level Global; and Jesse Tortora, who worked at Diamondback Capital Management.

Lawyers for Adondakis, Tortora and Goyal did not immediately respond to requests for a comment.

The criminal complaint -- signed by FBI agent David Makol, who was assigned to the Galleon investigation -- accused Newman and Chiasson of using information obtained by the three cooperators and their network of sources at companies to make illegal trades.

MORE HEADACHES FOR SAC

Horvath's arrest creates more headaches for fund industry titan Steven A. Cohen , who has not been accused of wrongdoing.

Federal investigators have been looking into allegations of wrongful trading at SAC for more than four years, Reuters has previously reported, and Horvath's arrest comes after criminal cases of others who have been tied to SAC.

Donald Longueuil, a one-time SAC portfolio manager, last year was sentenced to 2-1/2 years in prison for insider trading while Noah Freeman, another former SAC portfolio manager, cooperated with the government and pleaded guilty.

More than 50 people have been arrested or charged in overlapping federal insider trading probes that were first unveiled in October 2009. Most of these people have pleaded guilty or been convicted.

Many of the cases have been based at least in part on the use of government wiretaps authorized by federal judges. Four hedge fund firms -- Level Global, Diamondback, Loch Capital Management and Barai Capital Management -- were raided by the FBI in late 2010 as part of the insider-trading probe. Level Global, Loch and Barai have since folded.

Rajaratnam remains the best-known investor implicated in the probe. A jury convicted him of fraud and conspiracy last May. Rajat Gupta, a former chief of the consulting firm McKinsey & Co and director of both Goldman Sachs Group Inc and Procter & Gamble Co, has been charged with providing illegal tips to Rajaratnam. He is fighting those charges.

Zappos hacked: What did we learn?

On Sunday, Zappos CEO Tony Hsieh acknowledged that his company ? a subsidiary of Amazon ? had been hit by hackers, who managed to gain access to personal records for approximately 24 million shoppers. "We were recently the victim of a cyber attack by a criminal who gained?access to parts of our internal network and systems through one of our?servers in Kentucky," Hseih wrote.

He stressed that Zappos was cooperating with law enforcement; exact details on the nature of the breach have not yet been disclosed.?

So what have we learned from the Zappos fiasco? Well, for one thing, we're reminded yet again that even big companies are vulnerable to attacks. "It?s disturbing," tech analyst ? and recent online fraud victim ? Barbara Scott told the New York Times today. "Companies have to do a better job protecting our privacy. You would think companies like eBay and Amazon have the financial backing and wherewithal to take the proper security measures."

Of course, as Scott hints, Zappos isn't the only major company to be hit by hackers ? only the most recent. And with e-commerce occupying an ever-larger part of our daily lives, it's safe to say that we'll see at least a few more high-profile hacks in coming months. Which brings us to our second question: How did Zappos handle the breach??

Actually, pretty handily, according to most analysts. Over at Information Week, Matthew J. Schwartz runs down the eight lessons learned from the Zappos breach, including the importance of a detailed response plan. Schwartz quotes Tomer Teller, a security researcher at Check Point Software Technologies, who says Zappos "should be commended for alerting their customers in a timely fashion."?

Not that everyone is completely enamored with the reaction from Team Zappos. "Disappointingly, there is no mention of the security breach on the front page of the Zappos website ? one platform you would imagine they would use to inform their customers that there was a security problem of which they should be made aware," writes Graham Cluley, an analyst at Sophos.?

As for lessons, there are plenty to be learned, but perhaps chief among them is this: Change your passwords. A lot. "Typically people use one password to get into a number of systems," notes ABC analyst Brad Garrett. "And so as a result if you have someone?s password, you could easily compromise other accounts they have at other locations."
